1.1 These General Terms and Conditions apply to all orders placed by consumers through the online shop fit-beauty.de operated by Fit-Beauty, Allinger Str. 29, 82178 Puchheim (hereinafter "we" or "provider").
1.2 By placing an order, the customer accepts these terms and conditions.
2.1 The presentation of products in the online shop does not constitute a legally binding offer but an invitation to submit an offer.
2.2 By clicking the [Order/Buy] button, the customer submits a binding offer to purchase the goods in the shopping cart. The confirmation of receipt of the order is sent immediately by automated email and does not yet constitute acceptance of the offer.
2.3 A contract is only concluded when we accept the customer's offer by sending a separate order confirmation email or by dispatching the goods.
3.1 Orders are only accepted from persons who are at least 18 years old and fully legally capable.
3.2 The customer is responsible for ensuring compliance with import regulations of the destination country (especially for deliveries outside the EU). The customer bears any customs duties, taxes, and fees.
4.1 The prices displayed at the time of order apply. All prices include the applicable statutory VAT.
4.2 Shipping costs will be clearly communicated to the customer before placing the order.
4.3 For deliveries outside the EU, additional customs duties and taxes may apply, which are to be borne by the customer.
5.1 Unless otherwise agreed, delivery will be made within 30 days after dispatch confirmation.
5.2 If a product is unavailable, we will inform the customer promptly and refund any payments received.
6.1 Payment is made via the payment methods offered in the shop (e.g., credit card).
6.2 The delivered goods remain our property until full payment is received.
7.1 Consumers have a statutory right of withdrawal.
7.2 Special notice: The right of withdrawal expires prematurely for contracts concerning the delivery of sealed goods which are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery.
7.3 In case of manufacturing defects or damage, we provide replacement or refund according to statutory warranty rights.
7.4 For dissatisfaction with taste (opened product), we may, at our discretion, offer goodwill replacement or partial refund (up to 20%), provided the customer bears return shipping costs.
8.1 Statutory warranty rights apply.
8.2 We are fully liable for damages resulting from injury to life, body, or health caused by our negligence, as well as for intentional or grossly negligent breaches of duty.
8.3 For breaches of essential contractual obligations (cardinal obligations), liability is limited to typical foreseeable damages.
9.1 Our products are not intended to diagnose, treat, cure, or prevent any disease.
9.2 The information on our website does not replace medical advice. Customers should consult a physician before taking dietary supplements, especially if they have pre-existing conditions or take medication.
10.1 Information on the processing of personal data can be found in our separate Privacy Policy.
10.2 Credit card data is securely processed via external payment providers; we do not store full credit card numbers ourselves.
11.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
11.2 Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.
11.3 We reserve the right to amend these GTC at any time. For ongoing orders, the GTC valid at the time of contract conclusion apply.
